Complaint alleges vicarious liability and respondent superior, negligence, negligent hiring and supervision, negligent infliction of emotional distress, breach of contract, unjust enrichment, breach of fiduciary duties and/or constructive fraud, senior consumer protection act liability, and deceptive consumer sales act liability for negligent caregiving, real and personal property damage to Wilma Beck's home, and theft of more than $8,000 of her personal funds.
Status: Parties entered into a Release and Confidentiality Agreement on August 5, 2019; plaintiff paid $150,000 for dismissal with prejudice. Court dismissed the action August 26, 2019.

Complaint alleging violations of the Fair Labor Standards Act, the Ohio Wage Act, Ohio Prompt Pay Act, and Unjust Enrichment against SH-Delaware, a franchisee, and the franchisee's owner.
Status: Settlement Agreement entered March 25, 2025; ACK Home Care, LLC agreed to pay $42,000 to plaintiffs for a release of all defendants and dismissal with prejudice (SH-Delaware did not contribute). Case dismissed with prejudice April 11, 2025.

The Attorney General of Washington investigated "no-poach" provisions in SH-Delaware's franchise agreements and issued a Civil Investigative Demand requesting information related to the franchise agreements.
Status: On November 22, 2019 the parties entered into and filed an Assurance of Discontinuance (AOD). SH-Delaware agreed to notify franchisees of the AOD, seek to amend Washington franchise agreements to remove the non-solicitation of employees provision, and not include the non-solicitation provision nationwide.

Amended complaint alleged a former franchisee's caregiver was negligent in caring for the plaintiffs; claims of negligence, negligent hiring, violation of the New Jersey Consumer Fraud Act, and that SH-Delaware is vicariously liable based on agency and apparent agency theories. Plaintiffs requested compensatory, punitive, and special damages, plus interest and costs.
Status: Parties entered into a Release of All Claims on October 4, 2017; plaintiff paid $150,000. Stipulation of Dismissal With Prejudice signed November 29, 2017; action dismissed November 30, 2017.

You must operate the Franchised Business from an approved office within your Territory (not a residence or virtual/identity office). Before signing, the franchisor designates a Territory defined by zip codes (reserving the right to use other boundaries such as natural boundaries), determined case-by-case based on economic, demographic and geographic information, including number of residents 65 years and older. The franchisor will not establish or license others to establish a Senior Helpers Care Business in the Territory during the term so long as the franchisee complies, but reserves various rights (operating similar businesses outside Territory, dissimilar businesses, acquiring/being acquired by competitors, and advertising reaching into the Territory). Cross-Territorial Policies govern solicitation and servicing; violations carry fees (first: 50% of infringed Gross Sales + $2,500; second: 50% + $5,000; third: 50% + $10,000; intentional: 100% of Gross Sales per violation). Corporate Accounts program and Minimum Performance Standards apply.
