The complaint alleged breach of the Franchise Agreement and related personal guarantees, including alleged violations of confidentiality and post-termination non-competition provisions, as well as claims for tortious interference and unjust enrichment against certain affiliated third parties. The Franchisor sought injunctive relief and monetary damages, including costs and attorneys' fees.
Status: On February 20, 2026, the court entered a Consent Order and Stipulated Injunction resolving the action pursuant to a settlement that included injunctive and monetary relief. Bloom and Davis agreed to cease competing for two (2) years and are permanently prohibited from using, misappropriating, and/or disclosing Franchisor's confidential information. The order was entered by stipulation without adjudication of liability.

You may purchase between one and five Protected Territories under a single Franchise Agreement. Each Protected Territory will be described in terms of zip codes (all must be contiguous) and will be comprised of up to 250,000 individuals (according to the most recent Census data available at the time you and we sign the Franchise Agreement). Your Franchised Business must be operated from an office located within your Protected Territory (which may be a home office).
