Plaintiff served a Temporary Restraining Order seeking an injunction to prevent immediate and irreparable harm from the former franchisee's operation of a competing brand; claims that defendants breached eight franchise agreements and violated post-termination restrictive covenants including the covenant not to compete, and infringed plaintiff's trademarks.

Status: On December 4, 2024, the Court issued an Order Granting Default Judgement against defendants, finding breach of eight franchise agreements, valid termination, and liability for damages. The Court ruled the post-termination restrictive covenants reasonable, issued a declaratory judgment, and issued a permanent injunction on three counts (prohibiting violation of non-competition covenants; prohibiting violation of all other post-termination covenants and requiring return of confidential information; and prohibiting trademark infringement).

You are granted the right to develop and operate one A Place At Home Business within a designated Operating Territory. A Territory generally consists of a geographic area that includes approximately 40,000 Qualified Residents (individuals over age 65 residing within the Operating Territory per U.S. Census Bureau data). Additional Territories may be added subject to availability, approval, and additional Initial Franchise Fees. You will not receive an exclusive territory, but subject to Reserved Rights, franchisor will not open/operate or grant another franchisee an A Place At Home Business within your Operating Territory during the term.
